Goldstein Hall’s Litigation Team, led by Partner Brian J. Markowitz and Associate Max Rayetsky, secured dismissal of an appeal to the U.S. Court of Appeals for the Second Circuit brought by a Pro Se plaintiff.  The Motion to dismiss the appeal concerned the intricacies of the timing for filing of an appeal.  Specifically, the Court was required to determine when does the time to file a Notice of Appeal begin to run, upon the entering of the appealable order, or 3 days thereafter pursuant to Federal Rule of Civil Procedure 6(e).  Ultimately, the Court unanimously dismissed the appeal as untimely.
