Specifically, the Court determined that the church was entitled to Summary Judgment because a substantial fact, which formed the underlying basis of the transaction, was based upon a mutual mistake. The Court decided that no further triable issues of fact were needed for it to rescind the contract and dismiss the complaint in favor of the church.
